Mom Charged for Asking Son to Buy Her Pot, Police Say

Kelly Ann McIntyre allegedly texted her 17-year-old son and asked him to buy marijuana.

A Horsham mother is facing several charges in connection with her son's October arrest for marijuana possession. 

Kelly Ann McIntyre, 48, of Holly Drive, a former Hatboro-Horsham High School resource officer, is accused of sending her 17-year-old son text messages approximately nine hours before he was arrested in Upper Moreland Township for possession of marijuana with intent to deliver, according to the affidavit of probable cause. 

In the text messages which police said McIntyre admitted to sending, she allegedly asked her son how much an eighth of marijuana would cost and if he could purchase it from someone named "Fran."

According to police, her son responded that he was not able to get “middies,” but could get “headies," which, according to authorities, describes the amount and quality of marijuana to be purchased. 

Initially, police said McIntyre admitted to sending the text messages, but did so in an attempt to "set her son up," according to court documents.

McIntyre was said to have told police that she knew her son was smoking marijuana, but she wanted to know if he was selling it too.

She said family members had recently died from drug overdoses and she was against drug use, according to the documents. 

Police said McIntyre later began to cry and admitted that she had lied. McIntyre allegedly told investigators that she made the request of her son for a family member, who was "unable to purchase marijuana from his usual dealer," according to the affidavit.  

In a court appearance at district court this week, McIntyre waived her preliminary hearing and is set to be formally arraigned on May 8 at the Montgomery County Courthouse. A corruption of minors charge has been withdrawn. McIntyre still faces charges of criminal solicitation and criminal use of a communication facility. 

She remains free on $5,000 bail.
